Un homme et ses femmes au nom de la liberté de religion

En Colombie-Britannique, il existe une petite communauté de personnes (Bountiful) qui pratique la polygamie. Le but est de rendre les jeunes filles (dès l'âge de 13 ans) capables de s'occuper d'un logis dans le cadre d'un mariage. Les hommes eux se pratiquent à travailler à la ferme. Cette "secte" a été fondée il y a environ 50 ans par des dissidents mormons et depuis elle existe librement car le ministère de la province préfère ne pas agir au nom de la liberté de religion. Non mais! Pousse mais pousse égal, comme on dit ici! La polyandrie, une femme et plusieurs maris, représente environ 0.5% des régimes pluraux du monde. Voici les idées principales qui y seront développées: * Public legal information from all countries and international institutions is part of the common heritage of humanity. Maximising access to this information promotes justice and the rule of law; * Public legal information is digital common property and should be accessible to all on a non-profit basis and free of charge; * Organisations such as legal information institutes have the right to publish public legal information and the government bodies that create or control that information should provide access to it so that it can be published by other parties. Pour ma part, je pense que le droit n'a pas le choix d'évoluer avec les nouvelles technologies et, dépendamment de la façon dont on traite tout cela, plus de gens pourront avoir accès au savoir légal et donc pourront mieux se défendre.

L'adultère en 1921

Le droit de la famille est une des branches les plus surprenantes du droit (selon moi). Par exemple, voici ce que dit un juge de l'Ontario selon qui l'insémination artificielle sans le consentement du mari est un adultère (bon ça date de 1921): Orford v. Orford : les juges ayant précisé que adultery is the voluntary surrender of the reproductive facilities.

Mes débuts à la Régie

Cela fera bientôt 3 semaines que je suis à l'emploi de la Régie des alcools en tant qu'étudiante en droit. Une de mes collègues (droit UdM, 2e année) travaille avec moi pour l'été. À date, voici ce que l'on voit: - audience sans témoin - audience avec témoin - audience avec interprète - audience sans interprète - audience avec expertise - rencontre avec l'expert pour s'entendre sur ce qui sera dit à l'audience - création d'avis au titulaire et d'avis de convocation - recherches pour les dossiers des avocats - etc.

Sri Lanka Tigers

In Montréal, we've been hearing from their cause a couple of times... they are more and more rallying in the streets of downtown to attract people's attention... and they got it! While I'm reading more about the situation and try to get an objective perspective, here's what I read as Shyla's comment on a blog: "Abductions and killings have started in the East by the Sri lankan and Karuna forces. The International Community is preparing for the mission to conduct war Crimes, Genocide and Human Rights abuses in Sri lanka. Mahinda Rajapakse please get ready to come to Hague with your brothers and goons. It is sad that people who have no knowledge of the Eelam struggle and Sinhala Modayas and writing that has no sense. These SOB have no sense at all and think that the international Community is dumb. International community is collecting all criminal activities of the Regime and there is no escape for anyone. Those who have supported War Crimes and Genocide must be deported from the Western World to either Sri lanka or to Andaman." Hopefully she's right and International Courts will be ready to prosecute when the time comes!

The truth about second year

I don't talk a lot about law school (yeah, right!), but I found an enlightening blog text that describes it pretty well (from my first year's perspective, mind you).
